1. Acceptance of Work and Quotations

1.1. Any quotation provided is valid for 30 (thirty) days from the date of issue.
1.2. A deposit of 50% – 80% may be required before work commences on manufacturing or specialized repairs.
1.3. If a customer requests a “strip and quote” and subsequently rejects the quote, a stripping fee of R1000.00 excluding VAT will be payable before the item is released.
1.4. Customers will be liable for payment should you verbally confirm orders.

2. Payment Terms and Interest

2.1. All accounts are strictly COD (Cash on Delivery) unless a prior written credit agreement is in place.
2.2. In accordance with the National Credit Act, interest may be charged on all overdue accounts at the maximum legal rate allowed.

3. Right of Retention (Lien) and Storage Fees

3.1. The company exercises a Lien over all items until the full contract price, including storage fees, is paid.
3.2. Storage Fees: If an item is not collected within 30 (thirty) days of notification (of completion or quote rejection), a storage fee of R200.00 per day will be charged.
3.3. Risk: While we take all reasonable care, items left in storage for non-collection are held at the customer’s sole risk. The company is not liable for any deterioration, rust, or damage due to prolonged storage.

4. Disposal of Uncollected Goods (90-Day Rule)

4.1. If an item is not paid for and collected within 90 (ninety) days of the first notification, the company reserves the right to sell the item to recover costs for parts, labor, and storage.
4.2. This process will follow a Final Letter of Demand sent to the customer’s last known contact details, giving a final 14-day notice period.

5. Statutory Warranty (CPA Section 56)

5.1. All new manufactured parts and repairs carry a 6 (six) month warranty against defects in material and workmanship, provided the item has been used for its intended purpose and under normal operating conditions.
5.2. This warranty is void if:
  • The item has been tampered with or repaired by a third party.
  • The item was subjected to misuse, negligence, or used outside of hydraulic/thermal pressure specifications.
  • The customer provided their own parts for the repair (warranty applies to labor only in this case).

6. Limitation of Liability and Indemnity

6.1. The company shall not be liable for any consequential loss, loss of profit, or damages arising from the failure of a radiator or hydraulic cylinder, beyond the cost of repairing or replacing the specific component serviced by us.
6.2. The customer indemnifies the company against any claims by third parties arising from the use of the equipment after delivery.

7. POPIA (Data Protection)

7.1. With this document, we confirm that our company will only use your company details for processing of your personal information (name, contact details, vehicle/machine info) solely for the purpose of service delivery, invoicing, and legal notifications.
7.2. We will not share your data with third parties for marketing purposes.

8. Jurisdiction

8.1. These terms are governed by the laws of the Republic of South Africa. The parties consent to the jurisdiction of the Magistrate’s Court in the event of a legal dispute.
